SkyQuestCom Affiliate Terms and Conditions.
By entering into the SkyQuestCom Affiliate Program, the applicant, hereinafter referred to as the affiliate, agrees to abide by all the terms and conditions as stated below. 1. SkyQuestCom reserves the right to change the terms of this agreement by notifying on this website and/or by email. 2. The affiliate understands and agrees that any violation of this agreement can result in the immediate termination of this agreement and the forfeit of any and all commissions outstanding to the affiliate. 3. The affiliate is an independent contractor for SkyQuestCom and as such is neither an employee nor partner of SkyQuestCom. All taxes or other obligations that occur as a result of the affiliate\s participation in the SkyQuestCom Affiliate Program are the sole responsibility of the affiliate. 4. The affiliate agrees to deal honestly with SkyQuestCom and will not attempt to artificially inflate referrals or commissions in any way. The affiliate may register for the Affiliate Program no more than once. 5. Commission paid from SkyQuestCom differs from campaign to campaign. In the event of multiple affiliate referrals for any one new customer only one affiliate may earn a commission. The earliest cookie shall be taken as the affiliate of record for that customer. 6. All commission paid is subject to approval. Should SkyQuestCom find that commission amount has been manipulated or looks suspicious in any way, it will be put on hold and subject to further investigation. 7. Commissions are paid based on the different payment methods available for each country. Commissions are paid at least 30 days but no more than 60 days after the relevant subscription payment has been received, providing the total amount owed to the affiliate is USD 100.00 or greater specified by the affiliate. If the total amount owed is less than USD 100.00 payment is withheld until such time as the balance owed exceeds USD 100.00. In the event of a customer refund or chargeback any commissions paid on that subscription are immediately due to SkyQuestCom. Commissions are paid through bank draft or transfer through Paypal account. Any financial charges incurred will be borne by the affiliate where applicable. 8. SkyQuestCom reserves the right to change product pricing and available features and services at any time by notifying on this website and/or by email 3 days prior to implementing said changes. 9. The affiliate agrees to abide by the SkyQuestCom privacy policy. 10. The following governs the use and promotion of the SkyQuestCom service by the affiliate. SkyQuestCom hereby grants you non-exclusive license to use and promote this service. You may not modify, translate or create derivative works based on the service in whole or in part. Nor may you permit others to do so. You may not operate or develop a competitive service to the SkyQuestCom service. 11. You may not promote the SkyQuestCom service by spamming. You may not promote or use the SkyQuestCom service for spamming. Spamming includes but is not limited to the bulk sending of unsolicited messages or the sending of unsolicited emails which provoke complaints from recipients, the sending of junk email, the use of distribution lists that include people or businesses who have not given specific permission to be included in such distributions, email harassment of anyone including but not limited to transmitting any threatening, libellous, obscene or offensive material, the emailing of age inappropriate communications to minors. 12. Any promotion of SkyQuestCom that results in negative associations or in any way damages the reputation and good name of SkyQuestCom will result in immediate termination of the Affiliate Agreement and may result in legal action. 13. You shall not use or promote the SkyQuestCom service in any way which violates any city, state, national or international law or regulation, or which fails to comply with accepted internet protocol or etiquette. You shall not attempt to interfere in any way with the SkyQuestCom networks or network security or attempt to use the SkyQuestCom service to gain unauthorized access to any computer system. 14. You agree to defend, at your expense, any action brought against SkyQuestCom arising out of your promotion or use of the Service with any third parties or from your wilful misconduct. You will indemnify SkyQuestCom from any costs, damages and fees incurred by SkyQuestCom, which are attributable to such a claim. You will reimburse SkyQuestCom the full cost of any and all losses your use or misuse of the Service may incur, and you authorise SkyQuestCom to recover such losses without prior notice by any means. 15. The information and services included in or available through the Service may include inaccuracies or typographical errors. Changes are periodically added to the information herein. SkyQuestCom may make improvements and/or changes in the Service at any time. SkyQuestCom does not represent or warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available, are free of viruses or other harmful components. SkyQuestCom does not warrant or represent that the use or the results of the use of the Service or the materials made available as part of the Service will be correct, accurate, timely, or otherwise reliable. Further, SkyQuestCom reserves the right to make changes to any and all parts of SkyQuestCom products at any time, without obligation to notify any person or entity of such changes. 16.
